NAVIGATION SERVICE AGREEMENT

 

DESCRIPTION OF SERVICES: There is no fee or obligation to take the ProGuide3™ Survey. Beginning with full payment of the GLN Navigation Fees, GLN will act as client’s private advisor to guide them in their efforts to secure the golf-centric lifestyle they desire.  This may include advising on golf courses, golf clubs, and golf communities and includes the “Services” listed below.

Golf Life Navigator’s Client Navigation “Platinum Level Services” include:

A) Client access to and completion of the proprietary GLN ProGuide3™ Survey

B) GLN Navigator review and assessment of clients’ and spouse, if applicable, completed ProGuide3™ survey.

C) From survey data and possible direct communication with client, if deemed necessary, recommendation of two to four golf courses, clubs, and/or communities.

D) Introduction of client to a real estate professional to service their home purchase needs, if applicable.

E) Introduction to the membership director and/or General Manager of the selected clubs.

F) Scheduling of up to three (3) golf experiences. Each experience will be a minimum of nine (9)-holes. Note: Additional course and cart fees may be required and limitations may be present.

G) If client needs are not met by the initial Navigator choices, Navigator will seek out three (3) new choices that client can review as stated above.

H) First year membership in the Golf Life Navigators Club beginning from the date of payment.

1. PAYMENT. Client will pay to Golf Life Navigators for the “Platinum Services” (A – H above) the amount of $750 or $150 for GLN “Gold Services” (A – D above) or $99 for “Basic Services” (A – B above) ProGuide3™ Navigation that includes.   This services retainer fee shall be payable in advance.

2. TERM/TERMINATION. This Agreement and the “Services” described herein shall be in force for 24 months from the payment date or will terminate automatically upon completion of the home purchase and/or membership purchase whichever comes first. In the event the client does not close upon a home or club membership within the 24 month period, the client may opt to renew the agreement for an additional 24 months for an additional fee of $375.

4. SATISFACTION GUARANTEE.  Should client in any way be dissatisfied with the “Service” provided by Golf Life Navigators, client may request, in writing, a refund of 100% of services retainer. Full refund will be returned if request is received within 12 months of having paid fee.

5. ENTIRE AGREEMENT. This Agreement contains the entire agreement of the parties and there are no other promises or conditions in any other agreement whether oral or written. This Agreement supersedes any prior written or oral agreements between the parties.

6. SEVERABILITY. If any provision of this Agreement shall be held to be invalid or unenforceable for any reason, the remaining provisions shall continue to be valid and enforceable. If a court finds that any provision of this Agreement is invalid or unenforceable, but that by limiting such provision it would become valid and enforceable, then such provision shall be deemed to be written, construed, and enforced as so limited.

7. APPLICABLE LAW. This Agreement shall be governed by the laws of the State of Florida.

8. WAIVER OF LIABILITY. Final decisions regarding purchases of Club Memberships and/or Homes are wholly the responsibility of the buyer (GLN Client). Client Shall hold GLN and all its affiliated entities harmless of all claims in regards to these potential transactions.
